PDCA, Professional Driver Carrier Association Membership Agreement

RULES AND REGULATIONS

A.  PDCA Membership
PDCA offers two programs, one for professional drivers and the other for carrier companies. Professional drivers become a member of PDCA by opening a PDCA Frequent Fueler MoneyCard MasterCard© account (PDCA MoneyCard©) with Transportation Alliance Bank (TAB). Carriers become members of PDCA by opening a Transportation Clearing House (TCH) Fuel Account. Applications are available in Flying J C-stores.

Professional Drivers
You become a member of PDCA by obtaining a PDCA MoneyCard©. Membership is subject to any and all rules and regulations adopted by PDCA and these rules and regulations may be amended from time to time or terminated without notice to or consent by the member. To apply, you fill out a PDCA MoneyCard© Application. Upon approval of the application, TAB will establish an interest bearing checking account1 in your name. Within two to three weeks after your application is approved, you will receive new account checks in the mail along with instructions on how to make deposits.2  After TAB receives your initial deposit, TAB will mail your PDCA MoneyCard©. In order to award credits and/or points to your PDCA MoneyCard account, all purchases must be made using your PDCA MoneyCard as your form of payment. All credits or rebates will be credited to your account on the next statement following the month end when benefits were earned. Carrier Companies
Carriers become a member of PDCA by opening a TCH fuel account. Applications are available in Flying J C-stores or by calling TCH Customer Service: 888-824-7378. Membership is subject to any and all rules adopted by PDCA and these rules and regulations may be amended from time to time or terminated without notice to or consent by the member. You will also be subject to the rules and regulations of TCH for TCH accounts. In order to award credits and/or points to your TCH account, all purchases must be made using your TCH/PDCA card as your form of payment. All credits or rebates will be credited to your account on the next statement following the month end when benefits were earned.

2Each depositor is insured to $100,000.00 by FDIC. Each individual member must enroll separately only once in the program. You will also be subject to the rules and regulations of the Frequent Fueler MoneyCard MasterCard© card. The PDCA MoneyCard© is a debit card not a credit card, but is accepted wherever MasterCards are accepted, and are non-transferable. The PDCA MoneyCard© is the property of TAB and your right to use the card may be terminated any time by TAB at its sole and absolute discretion. Report a lost or stolen card to TAB at (800) 355-3063. The PDCA MoneyCard© is only to be used by the individuals to whom they are issued. The primary cardholder must authorize cardholder changes, including additions or deletions, and is responsible for the account.
B.  PDCA Discounts--Rebates/Credits discontinued beginning September 1st 2010
  1. As a PDCA MoneyCard© account holder or TCH account holder you will receive a 1 cent (1¢) rebate into your PDCA MoneyCard© account or one cent (1¢) credit to your TCH account for every gallon of Flying J diesel fuel purchased at a Flying J owned and operated facility with your PDCA MoneyCard© or TCH card over 1,350 gallons-per-month up to a 2,500 gallons diesel fuel purchased per month.
  2. You will also qualify for a five percent (5%) rebate applied to your PDCA MoneyCard© account or TCH account for every dollar over $100.00 per month minimum spent by you using your PDCA MoneyCard© or TCH card in Flying J's Thad's, Cookery, Country Market, Pepperoni's, Magic Dragon, J-Subs, and other company owned food restaurants; or at any Flying J owned and operated C-store.
  3. PDCA reserves the right to audit all purchases and has the right to withhold rewarding of discounts, rebates and benefits received through fraud, deception, perjury or in violation of PDCA rules and regulations.
  4. Non-fuel purchases recorded net of taxes and other items otherwise controlled by law.
  5. PDCA MoneyCard® account or TCH card account, benefits, rebates, or discounts may not be used in conjunction with any other promotional program. One truck per card.
  6. All transactions are processed independent of one another and may not be combined in a single transaction.
  7. Members of PDCA will be responsible for any and all tax or other charges that have been assessed on discounts, benefits or promotions offered pursuant to PDCA programs.
  8. The PDCA programs, benefits, cards, accounts or discounts are not valid where prohibited by federal, state or local law.
  9. PDCA reserves the right to modify or terminate any of its programs, including without limitation, PDCA membership/association, TCH accounts, at any time, and at its sole discretion, without prior notice to members.
  10. Discounts and other benefits must be earned by the member. You may not pool or combine your discounts or other benefits with the discounts or other benefits earned by other individuals and/or other programs.
  11. Discounts and other benefits are not transferable and may not be bartered, sold, gifted or assigned.
